RETURNS & REFUNDS

The Upscale Garage Sale values its customer relationships and offers a consumer return policy for any product purchased directly from our store, less any applicable shipping and handling fees. If for any reason you find an item less than satisfactory in any way, simply return it to us. We’ll credit your account.

Remember, Shipping and handling fees are NON-REFUNDABLE. Upon receipt of an item purchased the Buyer should examine the item to make sure it is the item ordered and the item received is in the condition as described on the site. If the item is not as described the Buyer may return the item to The Upscale Garage Sale within fourteen (14) days of the date of the order confirmation e-mail at buyer’s expense. The Buyer must report that they are returning the item by emailing orders@theupscalegaragesale.com, or the buyer may call 1-248-474-4676. You will need your order number when you contact us about the return.

All products purchased must be returned within fourteen (14) days in its original condition, container, with tags and original packing and any accompanying warranties or certificates from the date on the packing slip or invoice for a full refund credit. The product will be returned at the buyer’s expense. The Upscale Garage Sale is not authorized to take back any orders that have missed the return or deadline date, or any partial orders, or any items that have been altered or changed by the Buyer. Any problems with returned items should be referred to The Upscale Garage Sale’s Customer Service and Support at support@theupscalegaragesale.com or
1-248-474-4676.

Remember, the item must be in its original package not damaged, altered or changed in any way and sent to the return address provided by The Upscale Garage Sale. Any returned merchandise not returned under these guidelines will not be accepted for full refund credit.

Once the Seller acknowledges return receipt of the item in its original condition and packaging the Buyer's account will be credited for full refund minus shipping and handling.

Non-Refundable/Non-Refundable Item

These include new and gently used lingerie, undergarments and large pick-up only items. This also includes items that have been changed or altered in some way. Pick-up items are required to be inspected by Buyer before acceptance, and are not refundable and not returnable.

ORDERS

Orders are processed online ONLY – sorry, no phone orders will be accepted, unless the item ordered is being shipped to an address other than the one on the buyer’s credit card. Other verification will be required by telephone or email. To avoid any delay in your order being processed quickly please have the correct Part number with all the digits and letters required. Also, make sure you have the correct description of the item. Our goal is to make every shopping experience satisfactory and rewarding. STATE TAX

Michigan has a six percent (6%) sales tax for all Michigan residents. This tax is added to any item, with the exception of food products, sold to a buyer within the state of Michigan. It does not apply to buyers outside of the state of Michigan.

SHIPPING & HANDLING FEES

There are no surprised shipping fees and no hidden handling costs. We will treat you like the loyal, valued customers we hope you become. We will make every effort to keep our shipping and handling costs reasonable. We will charge the costs to ship regular USPS. However our fees are subject to change without notice due to a rate increase by USPS. Our nominal handling fee helps defray a small portion of our expenses to expedite your order and carefully hand package your merchandise. This fee applies to all orders large or small.

SHIPPING RATE BASED ON ORDER TOTAL:
$01.00 - $9.99 = FREE S/H
$10.00 - $14.99 = $7.95
$15.00 - $19.99 = $8.95
$20.00 - $24.99 = $9.95
$25.00 - $29.99 = $10.95
$30.00 - $39.99 = $11.75
$40.00 - $49.99 = $12.95
$50.00 - $99.99 = $13.95
$100.00 or more = $15.00


We find that our customers prefer we use the most economical method available. That’s why we normally ship through the USPS even though it’s often not the fastest option. However, at buyer’s request and expense to a more expeditious delivery, we will ship whichever way the buyer requests, just email or telephone your desired method. This means we will only charge additional fees where the customer wants an item rushed next day, sent priority mail, or request special shipping or handling, then an additional fee will be appropriate.

DISCLAIMER:

All crystal and other fragile items should be purchased with insurance in case of breakage, or damage in shipping. The Upscale Garage Sale will not be responsible for any items purchased without insurance that is damaged during shipping.

NOTE:

If Seller uses UPS and UPS packs your item for shipment, UPS will reimburse you if the item is either lost or damaged. This might be helpful when shipping fragile items.

DELIVERY

Orders in stock will ship within two (2) business days. All orders will be shipped via USPS prepaid, or by any of The Upscale Garage Sale shipping or other special shipping methods requested by the Buyer. The Upscale Garage Sale will use its best efforts to meet any scheduled date, but does not guarantee to do so. Failure to make shipment as scheduled does not constitute a cause for cancellation and/or legal damages of any kind. In the event of any delay requested by the Buyer, or any delay caused by incorrect addresses or inadequate shipping instructions the Seller will store all items ordered at the Buyer expense and risk for a reasonable period of time not to exceed 7 days.

WARRANTY AND LIMITATION OF LIABILITY

All goods are warranted by the Seller to be free from defects in material and workmanship, unless sold “AS IS” and all defects have been described and disclosed in the merchandise description to the Buyer. The Seller makes no warranty with respect to any defect, failure, deficiency which is:

  • Described ”As is, New or Used “is” item

  • Reported to the Seller within 24 hours of item receipt

  • Due to Buyer’s modification, disassembly, alteration, abnormal exposure to
    temperatures, dirt, or other corrosives, or water damage caused by the Buyer

  • Due to mishandling of buyer or others associated with the Buyer

  • Due to damaged in shipping if not insured by Buyer, if unique, or fragile


Buyer will be charged for any returned item that is damaged or damaged in shipping that was not returned in original packages or if inappropriately repackaged.

GOVERNING LAW

These terms and conditions of sale shall be governed by the laws of the state of MICHIGAN without regard to principles of conflict of laws. Any dispute to enforce any rights granted by this contract must be filed within one (1) month after delivery. These terms include any applicable taxes due (local, state and federal) which will be paid by the Buyer.
